These Terms of Use govern your use of the Claim Pilot website and Client Portal. By using this website, you agree to these terms.

About Claim Pilot

These Terms govern the use of Claim Pilot and the claim administration and recovery support services provided under the Claim Pilot brand by Moonstone 64 Investments (Pty) Ltd (Registration No. 2016/167956/07), trading as Claim Pilot. Claim Pilot provides administrative claim support, document preparation, claim submission support, follow-up assistance, recovery support and settlement administration for third-party damage claims. Claim Pilot does not provide legal advice or legal representation. Where legal services are required, a matter may be referred to an attorney.

Online-only service

Claim Pilot operates entirely online. To start a claim, please complete the claim check form and respond to any follow-up emails with the required documents.

How your information is used

We use the information you submit to assess, administer and progress your claim. Where necessary, we may share your information with insurers, responsible parties, claims administrators, assessors, attorneys, or other relevant parties involved in the claim. Please see our Privacy Policy for more detail.

No guarantee of outcome

Submitting a claim check does not mean your claim has been accepted. Third-party claims may be disputed, delayed, reduced or rejected. Claim Pilot does not guarantee that a claim will be accepted, admitted, settled or paid.

Referral to attorneys

If a matter requires legal advice, a formal demand, summons, litigation or court action, it may be referred to an attorney.

Your responsibilities

You agree to provide accurate and complete information and documents. Claim Pilot relies on the information you provide to assess and administer your claim.

Changes to these terms

Claim Pilot may update these Terms of Use from time to time. Continued use of this website after changes are posted means you accept the updated terms.

Portal account

The Claim Pilot Client Portal allows you to submit information, upload documents and track or communicate about your matter.

Your registered email address is used to verify access to your portal account. You are responsible for keeping access to that email account secure and must notify Claim Pilot promptly if you believe it has been compromised.

Electronic communications

You agree that Claim Pilot may use email, electronic forms, document uploads and other written electronic communications in connection with your matter.

Submission and acceptance of a matter

Submitting information or documents through the Client Portal does not mean Claim Pilot has accepted your matter for handling.

Claim Pilot may assess the information provided, request further information or documents and decline matters that are unsuitable, unsupported, uneconomical, outside Claim Pilot's service scope or otherwise inappropriate for Claim Pilot's online process.

Authority and Fee Agreement

If Claim Pilot accepts a matter for handling, the applicable Limited Authority, Mandate, Cession and Payment Direction and the applicable Fee Agreement govern Claim Pilot's authority and fee arrangement.

In short, Claim Pilot operates on a no recovery, no fee basis, subject to the terms of the applicable signed Fee Agreement.

Cancellation

You may terminate Claim Pilot's future administrative mandate by contacting Claim Pilot in writing.

Termination does not affect rights or obligations arising from work already performed where those rights or obligations are preserved by the applicable Authority or Fee Agreement.

No guarantee

Claim Pilot does not guarantee that any claim will be accepted, admitted, settled or successfully recovered.

Legal escalation

Claim Pilot provides claim-administration and recovery-support services and is not a law firm.

Where formal legal proceedings or legal representation are required, the matter may be referred to a practising attorney under a separate mandate.

Claim Advance interest registration

Claim Advance is a proposed service and is not currently available. Registering interest through the Claim Advance page is for market-research and product-development purposes only.

Registering interest is not an application for credit or finance. It is not an offer, a quotation, an approval or a pre-approval. Nothing is approved by submitting the form, no funds are reserved and no financing commitment is made. Claim Pilot does not promise that Claim Advance will be launched, and registering interest does not guarantee that you would be eligible for it.

If Claim Advance is ever launched, it would be governed by separate eligibility, regulatory, commercial and contractual requirements, and by its own terms.

Registering interest does not alter, accelerate, approve or otherwise affect any Claim Pilot recovery claim you may have.

Claim Pilot may use the information you provide for the research purposes described in the Privacy Policy, and may contact you about Claim Advance where you selected the applicable contact permission.
